Terms of Use
Effective October 13, 2026
These terms apply to the Otter Creek Trails iPhone app (the "app") and ottercreektrails.com, operated by Tyler Flynn in Lewis County, New York ("we", "us"). By using the app you agree to these terms. If you don't agree, please don't use the app.
1. Ride safely — the app is a navigation aid
- The app helps you find your way, but GPS, maps and trail information can be wrong, incomplete or out of date. Trail conditions change.
- Always carry a backup map, tell someone where you're going, and use your own judgment about weather, terrain, your horse and your abilities.
- Hazard and maintenance reports come from other riders and are not verified by us. The absence of a report doesn't mean a trail is safe.
- The SOS screen shows your coordinates to share. It does not contact emergency services and does not replace 911.
- Horseback riding and backcountry travel carry real risk. You ride at your own risk.
2. Trail access and DEC rules
- Otter Creek Trails is an independent app. It is not an official product of, or endorsed by, New York State, NYS DEC or any other agency.
- Showing a road, trail or place in the app does not mean it is open to the public or permitted for horses. Follow posted signs, closures and NYS DEC regulations, and respect private property.
- Do not use the app to publish or promote non-designated trails. Share rides privately with friends only.
3. Beta versions
Test versions distributed through TestFlight may contain bugs, may change or stop working, and may lose data. Please report problems so we can fix them.
4. Your account
You're responsible for keeping your password secure and for activity on your account. Give accurate information, and don't share your account. You can ask us to delete your account at any time (see the Privacy Policy).
5. Content you submit
- You keep ownership of the hazard reports, notes, photos, ride tracks and requests you submit ("your content").
- You give us a non-exclusive, royalty-free license to store, display, adapt and share your content within the app and its services, for example showing your hazard report to other riders or adding an approved destination to the map.
- Only submit content you have the right to share. Keep it accurate and respectful: no false reports, harassment, offensive material, or other people's personal information. This includes your display name and profile photo, which must not be offensive or impersonate someone else.
- We may edit or remove content, or suspend accounts, that break these rules or put riders at risk.
6. Subscriptions
Some features may require a paid subscription or pass in the future. When offered:
- Purchases are made through your Apple ID and handled by Apple under Apple's terms.
- Monthly and yearly subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. You can manage or cancel them in your iPhone's Settings → [your name] → Subscriptions.
- Refunds are handled by Apple according to its policies.
- If we remove content or suspend or end an account because it broke these terms, you are not entitled to a refund or credit from us for any unused subscription time. Refund requests for App Store purchases are decided by Apple under its policies.
- Prices and features may change; changes to subscription prices follow Apple's notice rules.
7. Apple's terms
If you downloaded the app from the App Store or TestFlight, Apple's Licensed Application End User License Agreement also applies. Apple is not responsible for the app or its support. If these terms conflict with Apple's for an App Store issue, Apple's terms control for that issue.
8. Our app and map data
The app, its design and its compiled map data are ours or our licensors'. Map data comes from public and open sources credited in the app under More → Map data and credits. Don't copy, resell or extract the app's map data or content except as allowed by law or the source licenses.
9. Disclaimers
The app is provided "as is" and "as available", without warranties of any kind, including accuracy, reliability, fitness for a particular purpose, or that it will be available or error-free, to the fullest extent allowed by law.
10. Limitation of liability
To the fullest extent allowed by law, we are not liable for any indirect, incidental, special or consequential damages, or for any injury, loss or damage resulting from your use of the app or reliance on its information, including getting lost, trail conditions, or the actions of other riders. Our total liability for any claim is limited to the amount you paid us for the app in the 12 months before the claim. Some places don't allow these limits, so they may not fully apply to you.
11. Ending use
You can stop using the app at any time. We may suspend or end access for anyone who breaks these terms, or discontinue the app.
12. Governing law
These terms are governed by the laws of the State of New York, without regard to conflict-of-law rules.
13. Changes
We may update these terms. If we make important changes, we'll update the date above and let users know in the app. Continuing to use the app means you accept the updated terms.
